
Information regarding TMVOA's upcoming election
In June 2022, the Town of Mountain Village joined Friends of TMVOA in suing Telluride Mountain Village Owners Association (TMVOA), seeking to assure TMVOA operates in conformance with the Colorado Common Interest Ownership Act (CCIOA), the Colorado Non-Profit Act, and the federal tax regulations. In addition, the Town sought to redress the fact that TMVOA assessed the Town annual dues without permitting the Town to vote on TMVOA matters.
In May of 2023, TMVOA, the Town, and Friends of TMVOA entered into a Settlement Agreement to resolve the dispute between the parties. Among other things, the Settlement Agreement addresses several issues of concern to the Town:
- Eliminates Telluride Ski and Golf's (TSG) voting rights in Class A (Residential), Class B (Lodging), and Class C (Commercial)
- Reallocates all of TSG’s voting rights to Class D (Mountain Operator)
- All voting rights will be allocated by “site” ownership rather than density
- Eliminates dues to the Town, while maintaining the Town’s status as a non-voting member
- Recognizes the Town’s right to attend meetings, inspect documents as a voting member, and bring future suit against TMVOA
In order to implement the Settlement Agreement, TMVOA members must approve amendments to the Articles of Incorporation, the Bylaws, and the Declaration.
As a party to the Settlement Agreement, the Town supports the proposed amendments.

The amendments incorporate the provisions of the settlement agreement that were approved by the TMVOA Board, Friends of TMVOA, the Town of Mountain Village and TSG.
